Káhareži Fondazár is a nonprofit public charity recognised under Section 501(c)(3) of the United States Internal Revenue Code. The foundation acts as a fiscal host on Open Collective for selected projects and initiatives that serve a clear public-benefit purpose and align with the foundation's charitable mission.
These Terms of Fiscal Hosting are intended to meet the expectations and requirements of Open Collective fiscal hosting, U.S. nonprofit law, and general standards of fiduciary responsibility, transparency, and accountability.
1Purpose of Fiscal Hosting
Fiscal hosting is offered to enable cultural, educational, humanitarian, advocacy, and other public-benefit projects to raise and manage funds responsibly without forming their own legal nonprofit entity.
Hosted projects must operate in good faith and use all funds solely for lawful, ethical, and mission-aligned purposes consistent with Káhareži Fondazár's tax-exempt status.
Fiscal hosting does not imply ownership of the project, endorsement of all viewpoints expressed by project participants, or control over daily operations beyond what is required for legal, fiduciary, and compliance obligations.
2Charitable Purpose and Mission Alignment
All hosted projects must further one or more charitable purposes recognised under U.S. nonprofit law, including but not limited to:
- Education and scholarship support
- Cultural development and preservation
- Humanitarian relief and public health initiatives
- Civic engagement and advocacy permitted under 501(c)(3) regulations
Projects whose primary purpose is commercial activity, private enrichment, or activities unrelated to public benefit are not eligible.
Káhareži Fondazár retains final discretion in determining whether a project qualifies as charitable and aligned with its mission.
3Eligibility Criteria
To be eligible for fiscal hosting, a project must:
- Serve a clear public or charitable purpose
- Align with values of responsibility, transparency, and community benefit
- Comply with all applicable laws and Open Collective platform policies
Projects must NOT:
- Promote hatred, violence, discrimination, or illegal activity
- Jeopardise the foundation's nonprofit or tax-exempt status
- Exist primarily for private financial gain
Projects may be informal groups, early-stage initiatives, or established efforts without independent nonprofit status. Acceptance is subject to administrative capacity and review.
4Financial Oversight and Fiduciary Responsibility
As fiscal host, Káhareži Fondazár assumes legal and fiduciary responsibility for funds raised through Open Collective under its sponsorship. Accordingly, the foundation:
- Holds all contributed funds in its own bank accounts
- Ensures funds are used exclusively for charitable purposes
- Reviews and approves expenses prior to payment
- Maintains complete and accurate financial records
- Provides public financial transparency through Open Collective
Important: All funds raised are legally the property of Káhareži Fondazár and are held in trust for charitable use in support of the hosted project.
5Expense Review and Disbursement
Hosted projects may request disbursements only for documented, project-related expenses. Each request must include:
- Receipts, invoices, or comparable documentation
- A short explanation of how the expense supports the approved project purpose
Káhareži Fondazár reserves the right to request additional documentation, delay payment during review, or decline expenses that are inconsistent with charitable use, nonprofit law, or these terms.
Approval of an expense does not imply approval of future or similar expenses.
6Permitted and Prohibited Uses of Funds
Funds raised under fiscal hosting:
Must:
- Be used exclusively for the approved project
- Not provide improper private benefit
May NOT:
- Be distributed as personal income unless explicitly permitted
- Be used for partisan political campaigns
- Be used for illegal or fraudulent activities
Limited advocacy and lobbying are permitted only within the bounds of U.S. nonprofit law and must be disclosed if applicable.
7Fiscal Hosting Fee

This fee supports:
- Administrative and operational costs
- Accounting, bookkeeping, and financial review
- Legal, regulatory, and compliance obligations
- Processing and review of expense requests
- Káhareži Fondazár's own charitable programmes
Open Collective platform fees and payment processing fees are separate and additional.
8Identity Verification and Compliance
For legal compliance, financial oversight, and risk management, Káhareži Fondazár requires identity verification for the responsible project lead(s).
Verification may be required prior to approval for fiscal hosting and prior to releasing any funds. Identity information is handled confidentially and used solely for compliance and recordkeeping purposes.
9Reporting, Communication, and Transparency
Hosted projects are expected to:
- Respond promptly to reasonable requests for information
- Maintain accurate financial and expense records
- Notify Káhareži Fondazár of material changes to leadership, scope, or activities
- Provide brief updates when reasonably requested
Note: Failure to communicate or maintain adequate records may result in delayed payments, suspension, or termination of hosting.
10Compliance With Law and Platform Policies
Hosted projects must comply with:
- All applicable local, state, federal, and international laws
- U.S. nonprofit and tax-exemption requirements
- Open Collective platform terms and policies
Projects operating outside the United States are responsible for compliance with applicable local regulations.
11Suspension and Termination
Fiscal hosting may be terminated by either party with reasonable notice. Káhareži Fondazár reserves the right to suspend or terminate hosting immediately if:
- Legal or regulatory compliance is at risk
- Funds are misused or misrepresented
- Activities threaten the foundation's tax-exempt status
- Required documentation or communication is repeatedly not provided
During suspension, expense payments may be paused pending resolution.
12Disposition of Funds Upon Termination
Upon termination, remaining funds will be handled in accordance with charitable purpose and legal requirements. Depending on circumstances, funds may be:
- Transferred to another qualified fiscal host or sponsor
- Reallocated to a closely aligned charitable purpose administered by Káhareži Fondazár
Important: Funds may not be returned to donors or distributed for private use.
13Independent Relationship
Fiscal hosting does not create an employment, partnership, joint venture, or agency relationship. Hosted projects remain independently operated and responsible for their own activities, decisions, and communications.
14Amendments
These Terms of Fiscal Hosting may be updated periodically to reflect changes in law, regulatory guidance, or platform requirements. Material changes will be posted publicly. Continued participation in fiscal hosting constitutes acceptance of updated terms.
